In spite of various changes that led to GATT 194710 being credited with a shift away from traditional diplomacy-based dispute settlement towards a more legalistic approach, 11 it largely fell short of the type of institutional and jurisdictional model of dispute resolution established by the Dispute Settlement Understanding (DSU).
The DSU established a compulsory dispute settlement system covering all of the agreements annexed to the Marrakech Agreement Establishing the World Trade Organization.
It encompasses the relevant procedural rules and guidelines, with the main purpose of enhancing a secured and predictable global trading system.13 Moreover, the rules provided in the DSU also function as a central element in preserving the balance of rights and obligations of WTO members.14
